Are you a business or nonprofit trying to understand which insurance policy is right for you?  Don’t fret. Changemaker Legal has simplified the information you may need into this short and easy quiz  Find out which Friends character you are and which insurance policy you need to start your own business.  But first, let’s answer the question many have asked at some point in life: What is insurance?  Insurance is a product that limits potential financial losses caused by unanticipated circumstances by distributing the risk of loss amongst policyholders.

 

Disclaimer: We have provided an overview of common insurance types.  This is not an exhaustive list of insurance types and should not be relied upon when making insurance decisions.  Consult with a licensed and qualified insurance broker to determine which insurance types are most appropriate for you and your business.

You may want to consider Media Liability Insurance.  This will allow you to offload some risk related to potential allegations of defamation, copyright infringement, factual errors, or plagiarism.  As someone super Type-A, you know it’s best not to risk it.

You may have been born with a silver spoon in your mouth, but you’re going to need to get savvy about insurance if you truly want to start a clothing store because there will be significant risks involved. You should consider the following: 

 

  • Business Owner Policy (BOP): This combines protection for major property and liability risks in one insurance package by bundling the following:

    • General Liability Coverage is particularly important for any business that allows the public onto its property. This covers some costs of accidental injuries on the property and property damage. 
    • Commercial Property Insurance could cover the costs of damage, for example, due to fire or theft, to the business equipment or property.
    • Business Interruption Insurance replaces lost business income when a business needs to temporarily shut down, for example, due to a lightning strike or fire.
    • Product Liability Insurance is designed to cover claims that a product you sold caused injury to someone or damage to their property.  Best to guard against any unfortunate wardrobe malfunctions.

  • Employment Practices Liability Insurance protects business owners from employment-related lawsuits such as harassment, discrimination, and wrongful termination suits.  Fashion can be a cut-throat industry, and you want to be prepared if any disputes turn legal.

  • Workers’ Compensation Insurance pays employees’ medical expenses when employees are hurt or sick due to their jobs by, for example, falling off a ladder while stocking merchandise. 

  • Employee Health Insurance: An employee benefit that pays for many employee medical expenses. This will help you recruit the best sales reps.

  • Cyber Liability Insurance: This could cover costs related to cyberattack and data breach incidents. You’ll be holding onto customers’ credit card information, and you could face steep costs if that data ends up in the wrong hands.

If, like Ross, you’re looking to start a camp for minors, you may also want to purchase a Business Owner Policy (see Rachel’s section for more details) as well the other insurance types described below, some of which are required in certain jurisdictions:

  • Disability Insurance covers lost wages due to injuries or sicknesses. ​

  • Directors and Officers Liability Insurance covers directors and officers who are sued for their actions when carrying out their duties for the organization.   Your directors and officers will want to see that you have this kind of insurance before they volunteer to oversee the camp.

  • Commercial Auto Insurance covers car repair and accident claim costs of vehicles used for camp purposes.

  • Abuse and Molestation Liability Insurance could cover legal claims brought against you or your staff over allegations of child abuse or molestation.  You’ll hire the best people and conduct extensive background checks, but it’s hard to prevent all potential human errors. 

  • Commercial Umbrella Insurance helps to pay claims that are outside of the limits of an underlying insurance policy.  This kind of policy often covers the legal, medical, and property expenses related to such claims.

If you truly want to help people without creating significant risks for yourself, you should consider getting insurance, including the following:

  • Professional Liability Insurance: This type of insurance allows professionals in specific areas of expertise to be protected against claims of negligence, malpractice, mistakes, or misrepresentations.  This will help cover the costs of customers’ injuries you swear “were like that when you met them.”

  • Business Interruption Insurance generally replaces lost income when a business needs to temporarily shut down, such as due to another global pandemic in which people don’t want to touch each other with a ten-foot pole.

With this kind of remote small business, it’s good to consider General Liability Insurance and Professional Liability Insurance. Chandler may also want Cyber Liability Insurance if he takes payments via credit card or handles other sensitive data. Workers’ Compensation InsuranceEmployee Health Insurance, and Employment Practices Liability Insurance coverage are also recommended if he hires employees.
